By accessing or using Top Title, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Top Title is an AI-powered SEO metadata optimization platform that uses artificial intelligence and large language models to help users improve their website's search engine visibility by:

• Analyzing website content and Google Search Console data
• Generating optimized page titles, meta descriptions, and H1 tags using AI
• Providing bulk optimization capabilities for multiple pages
• Offering insights and recommendations for SEO improvement

The Service is provided on a credit-based system where each page optimization consumes one credit.

3. AI-Generated Content and Limitations

3.1 AI-Powered Service

Our Service utilizes artificial intelligence, including large language models (LLMs), to analyze content and generate SEO metadata recommendations. By using the Service, you acknowledge and agree that:

• All metadata suggestions are generated by AI systems and may contain errors, inaccuracies, or inappropriate content
• AI-generated content is based on training data and algorithms that may have limitations, biases, or outdated information
• The Service provides suggestions and recommendations, not guaranteed outcomes
• You are solely responsible for reviewing, editing, and implementing any AI-generated content

3.2 No Guarantee of Results

While our AI is designed to generate SEO-optimized metadata, we make no guarantees that:

• Implementing our suggestions will improve your search engine rankings
• AI-generated content will be appropriate for your specific brand, audience, or industry
• The content will be free from errors, duplications, or inconsistencies
• The suggestions will comply with all search engine guidelines or policies

3.3 User Responsibility

You agree to:

• Review all AI-generated content before implementing it on your website
• Ensure that any content you use complies with applicable laws and regulations
• Take responsibility for the final content published on your website
• Not rely solely on AI recommendations for critical business decisions

4. Account Registration and Eligibility

4.1 Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information
• You will maintain the security of your account credentials

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information remains current and accurate

5. Use of Service

• Attempt to circumvent usage limitations or billing systems

6. Credits and Payment Terms

6.1 Credit System

Our Service operates on a credit-based model designed to provide fair, scalable access to AI-driven SEO optimization:

Credit Allocation

• We may, in our sole discretion, provide promotional credits to new accounts during sign up or as part of special promotions
• Additional credits can be purchased through our pricing plans
• Credits do not expire unless otherwise specified

Credit Consumption

Credits are consumed based on successful processing:

• Primary Consumption: One (1) credit is consumed for each URL you submit when we successfully generate and return a complete set of optimized metadata (title, meta description, and H1 tag)
• Unsuccessful Processing: No credit is consumed if we cannot access a URL (due to 404 errors, server issues, or unparsable content) or if internal errors prevent optimization
• Re-processing URLs: Submitting the same URL again will consume new credits, as this initiates a fresh analysis based on current content
• Failed Attempts: Our system only charges for successful optimizations that deliver usable results

6.2 Payment Terms

• All payments are processed securely through third-party payment processors
• Prices are subject to change with reasonable notice
• All sales are final unless otherwise specified
• We may suspend service for non-payment after reasonable notice

6.3 Refunds

Credits are generally non-refundable. However, we may provide refunds at our sole discretion in cases of:

• Technical issues that prevent service delivery
• Duplicate charges or billing errors
• Service termination by us for reasons other than Terms violations

Credits and Service Discontinuation

In the event of service changes or discontinuation:

• Temporary Service Interruptions: Credits remain in your account and will be available when service resumes
• Service Discontinuation by Company: If we decide to permanently shut down Top Title, we will provide at least 30 days' notice and offer refunds for unused purchased credits (free credits are not refundable)
• Force Majeure Events: If the service must be terminated due to circumstances beyond our control (regulatory changes, natural disasters, etc.), we will make reasonable efforts to provide refunds for unused purchased credits
• Account Termination by Company: If we terminate your individual account for violations of these Terms, no refunds will be provided for remaining credits
• Account Deletion by User: If you choose to delete your account, all remaining credits (both purchased and free) are forfeited

6.4 Credit Transfer Restrictions

Credits purchased or awarded through Top Title may not be transferred or sold to any other person or entity, and may only be used by the holder of the account to which the credits are associated.

7. Data and Privacy

7.1 Your Data

You retain ownership of your website data and content. By using the Service, you grant us permission to:

• Access your Google Search Console data as necessary for service delivery
• Process your website content to generate optimization recommendations
• Store and analyze data to improve our Service
• Use aggregated, anonymized data for research and development

7.2 Google Search Console Integration

Our Service integrates with Google Search Console to provide enhanced SEO insights. By connecting your Google Search Console account, you understand and agree that:

Authorization and Access

• You authorize us to access your Google Search Console data through Google's OAuth system
• We will access site performance data, search queries, page impressions, click-through rates, and related SEO metrics
• We may retrieve your verified website properties and sitemap information

Data Usage and Retention

• GSC data is used to generate personalized SEO recommendations for your connected properties
• We may store GSC data to provide historical analysis and trend identification
• We comply with Google's API usage policies and data retention requirements
• You can revoke our access to your GSC account at any time through your Google account settings or through our account settings page

Third-Party Integration Disclaimers

• Google Search Console integration is subject to Google's terms of service and API availability
• We are not responsible for changes to Google's API, data access restrictions, or service interruptions
• GSC data accuracy and completeness are determined by Google, not by our Service
• Google Search Console access is required for our optimization service; disconnecting your GSC account will prevent us from generating personalized recommendations

7.3 Geographic Limitations and Payment Restrictions

Access to Top Title's paid services is currently restricted based on geographic location:

• US-Only Billing: Credit purchases require a US billing address and payment method ("US" billing includes all 50 states, Washington D.C., and US territories)
• Account creation and free credit usage are available globally
• Paid features and credit purchases are limited to customers with US billing addresses
• Non-US payment attempts will be automatically declined by our payment processor
• We may expand to additional countries in the future with appropriate notice

7.4 URL Access and Content Scraping

To provide personalized SEO recommendations, our Service accesses and analyzes the URLs you submit. By submitting URLs, you acknowledge and agree that:

• We will access and retrieve content from the submitted URLs using automated scraping technology
• We may extract and analyze text content, HTML structure, meta tags, headings, and other publicly accessible page elements
• This data is used solely to generate personalized metadata recommendations for your specific content
• We implement respectful scraping practices, including reasonable request rates and standard web crawling protocols

7.5 User Warranties Regarding URLs

By submitting URLs to our Service, you represent and warrant that:

• Legal Right to Submit URLs: You warrant that you have the legal right to submit URLs to our service, either as the website owner, authorized representative, or with proper permission
• Compliance with Robots.txt: While we strive to respect robots.txt directives, you acknowledge that our automated scraping may occasionally conflict with website restrictions
• No Harm to Origin Servers: We implement reasonable measures to prevent excessive load on origin servers, but you acknowledge that automated scraping carries inherent technical risks

7.6 Scraping Limitations and Liability

While we strive to access websites responsibly:

• We are not responsible for any disruption to your website caused by our access attempts
• Some URLs may be inaccessible due to technical restrictions, server configurations, or security measures
• We may be unable to process password-protected, geofenced, or otherwise restricted content
• You acknowledge that website scraping inherently involves technical risks

7.7 Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Trend Growth Partners LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Rights

You retain all rights to your original content. The optimized metadata generated by our Service is provided to you for your use, and you may implement it on your websites without restriction.

7.3 Feedback

Any feedback, suggestions, or improvements you provide regarding the Service may be used by us without any obligation to compensate you.

9. Service Availability and Modifications

8.1 Availability

While we strive for high availability, we do not guarantee that the Service will be:

• Available at all times without interruption
• Free from errors or defects
• Compatible with all systems or browsers

8.2 Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING:

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TREND GROWTH PARTNERS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Trend Growth Partners LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

12. Termination

• Non-payment of fees

• Inactivity for extended periods

Upon termination, all rights and obligations under these Terms will cease, except those that by their nature should survive, including payment obligations, warranty disclaimers, and limitations of liability.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas for any disputes that cannot be resolved through the above process.
